VetKey Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the VetKey service, including our websites and applications offered under the VetKey name (the “Service”). The Service is operated by J1 Media Productions LLC, an Arizona limited liability company, doing business as VetKey (“VetKey,” “we,” “us,” “our”).

By creating an account, starting a trial, purchasing a subscription, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility; Who the Service Is For

  1. Military-affiliated users only. The Service is intended for U.S. military-affiliated individuals, including veterans, active-duty service members, and dependents (including spouses and eligible children), and others with a qualifying military affiliation as determined by third-party providers and merchants.
  2. 18+ only. You must be at least 18 years old to use the Service. We do not knowingly permit minors to create accounts. If we learn you are under 18, we may suspend or terminate your account.
  3. Authority. If you use the Service on behalf of an organization, you represent you have authority to bind that organization to these Terms.

2) Description of the Service

VetKey provides tools intended to help users discover and manage information about discounts, benefits, programs, and resources. Features may include: onboarding questionnaires and user profiles, eligibility matching, directories and listings, location-based discovery and maps, saved items/favorites, notes, reminders and notifications, and community features such as reviews/comments/forums.

The Service is currently offered in beta and may change frequently. We may add, modify, suspend, or discontinue any part of the Service at any time.

3) Not Government; No Professional Advice; No Guarantees

  1. No government affiliation. VetKey is a private company and is not affiliated with the U.S. Department of Veterans Affairs (VA), the U.S. Department of Defense (DoD), or any other government entity.
  2. Informational purposes only. The Service provides general information and tools for convenience. VetKey does not provide legal, financial, medical, tax, or benefits counseling advice.
  3. No eligibility guarantees. Eligibility outcomes and matches are informational and may be inaccurate or incomplete. Providers and merchants control their own requirements and may change them at any time.
  4. You must verify. You are responsible for confirming eligibility, requirements, availability, deadlines, discount terms, and any “limited time” offers directly with the relevant provider, agency, organization, or merchant.

4) Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and share information and explains your choices.

5) Accounts; Security; One Account Per Person

  1. Accurate information. You agree to provide accurate information and keep your account information up to date.
  2. Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  3. One account. You may not create or maintain more than one account per person without our written permission.
  4. Unauthorized use. You must notify us promptly if you suspect unauthorized access or use of your account.

6) Military Status; Misrepresentation; Fraud

  1. No verification (for now). VetKey does not currently verify military status as a condition of account creation, but we may implement verification later.
  2. No misrepresentation. You may not misrepresent your military affiliation or eligibility for any discount/benefit.
  3. Enforcement. If we believe you misrepresented eligibility, engaged in fraud, or used the Service unlawfully or wrongfully, we may suspend or terminate your account immediately.

7) Community Content (Reviews, Comments, Forums)

  1. Private nature. Community features are intended for use within the Service. You agree not to reproduce, redistribute, or publish Service content (including listings and community content) outside the Service without our permission.
  2. Your responsibility. You are responsible for content you submit (including reviews/comments) and agree not to post unlawful, harmful, or abusive content.
  3. Moderation. We may remove or restrict access to any content at any time, for any reason, including to enforce these Terms.

8) No Uploads; Sensitive Data Restrictions

  1. No document uploads. The Service does not currently support uploading documents or images (e.g., DD214, IDs, medical documents). Do not submit such materials through the Service.
  2. Sensitive information. You agree not to submit highly sensitive personal information through the Service, including SSNs, full government ID numbers, passport data, driver’s license numbers, medical records, or similar sensitive identifiers.
  3. If submitted anyway. If you submit prohibited sensitive information, you acknowledge it is at your own risk and you authorize us to delete it.

9) Location Features; Location History

  1. Location-based discovery. If you enable location permissions, we may collect and use device location to provide nearby resources and map-based features.
  2. Location history. You agree that VetKey may store location history to support functionality, personalization, analytics, fraud prevention, and service improvement, as described in the Privacy Policy.
  3. Disabling location. You can disable location permissions, but some features may not function.

10) Third-Party Services; Links; Maps; Directions

  1. Third parties. The Service may reference or link to third-party services (including providers, merchants, and mapping/directions services). Those third parties control their own content and policies.
  2. No responsibility. VetKey is not responsible for third-party content, accuracy, availability, pricing, promotions, fulfillment, or privacy practices.
  3. Directions. If the Service links you to third-party directions or external map services, your use is governed by those third-party terms.

11) Listings; Affiliate Links; Paid Placements; No Endorsement

  1. Directory nature. VetKey is a directory and discovery platform. Listings may change at any time and may be incomplete or outdated.
  2. Affiliate compensation. Some links may be affiliate or referral links, and VetKey may earn commissions or other compensation if you engage with those links or providers.
  3. Featured listings. VetKey may accept paid placements, sponsorships, or “featured” listings.
  4. No endorsement. Inclusion, ranking, or featuring does not mean VetKey endorses, certifies, or guarantees any provider, merchant, discount, or benefit.

12) Data Export and Restrictions on Copying the Directory

  1. No exporting the directory. You may not export, reproduce, scrape, harvest, or otherwise extract the VetKey benefits/discount directory or substantial portions of it for use outside the Service.
  2. Limited user data portability. We may provide account-related exports (if/when offered). Any exports are provided “as is” and may be limited for security and anti-abuse reasons.
  3. Enforcement. We may rate-limit, block, suspend, or pursue legal remedies for unauthorized extraction or copying.

13) Acceptable Use

You agree not to:

  • use the Service for unlawful activities;
  • violate any applicable laws or regulations;
  • attempt to bypass security, access non-public areas, or probe/scan/test vulnerabilities;
  • interfere with or disrupt the Service, including via automated requests or excessive load;
  • upload malware or harmful code (including through inputs, links, or attempted file submissions);
  • scrape, crawl, copy, harvest, or index the Service at scale without written permission;
  • reverse engineer or attempt to derive source code except where prohibited by law;
  • impersonate others or misrepresent identity or affiliation;
  • spam, harass, threaten, or abuse other users;
  • use the Service to compete unfairly by copying the Service, listings, structure, or “look and feel.”

14) Subscription, Trial, Billing, Taxes, and Cancellation

  1. Paid-only service. VetKey is a paid subscription service.
  2. Trial. We may offer a 7-day free trial. Unless you cancel before the trial ends, your trial will automatically convert to a paid subscription and you authorize us to charge your payment method.
  3. Billing. Subscriptions are billed monthly, with an option to pay annually (which may include a discount, e.g., “save 20% annually,” as presented at checkout).
  4. Payments and processors. Payments are processed by Stripe or another payment processor. VetKey does not store complete payment card details.
  5. Taxes. Applicable taxes may be charged as required by law. (VAT generally applies outside the U.S.; the Service is U.S.-only, but we may apply tax calculation tools as needed.)
  6. Cancellation. You may cancel via the Stripe customer portal (if provided) or by emailing support. Cancellation takes effect at the end of the current billing period unless otherwise required by law.
  7. Pricing changes. We may change prices or plan features with notice. Changes apply at the next renewal unless stated otherwise.
  8. Failed payments. If a payment fails, we may provide a 3-day grace period. After that, we may pause or restrict access until payment is successful.

15) Refund Policy (Temporary Terms Until a Separate Policy Exists)

  1. 14-day discretionary refunds. Refund requests must be made within 14 days of the start of the paid plan period. Refunds are granted at VetKey’s discretion and may require a stated reason.
  2. No guaranteed refunds. Except where required by law, fees are generally non-refundable, including for partial billing periods.

16) Intellectual Property; Trademarks

  1. VetKey IP. The Service and all associated content, features, functionality, design, software, and branding are owned by VetKey or its licensors and are protected by intellectual property laws.
  2. Trademarks. You may not use VetKey trademarks, logos, or branding without prior written permission, except for nominative use for press/media references that do not imply endorsement and do not mislead.
  3. Third-party marks. Third-party names/logos are property of their respective owners.

17) Feedback

If you provide feedback or suggestions, you grant VetKey the right to use them without restriction or compensation.

18) Suspension and Termination

  1. By you. You may stop using the Service at any time and may delete your account in-app.
  2. By us. We may suspend or terminate your access at any time, including if we believe you violated these Terms, created risk, engaged in fraud, misused the Service, or for any lawful reason.
  3. Effect of termination. Upon termination, your right to access the Service ends.

19) Account Deletion; Data Retention

  1. Deletion request. When you delete your account, we will delete or de-identify personal information consistent with the Privacy Policy and applicable law.
  2. Retention window. We may retain certain information for a limited period at our discretion for security review, fraud prevention, dispute resolution, tax/accounting, and legal compliance.
  3. Logs. We may retain logs and records necessary to maintain security, prevent abuse, and comply with law.

20) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VETKEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT LISTINGS, ELIGIBILITY MATCHES, OR CONTENT ARE ACCURATE, COMPLETE, OR CURRENT.

21) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  1. VETKEY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
  2. VETKEY’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID VETKEY IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply.

22) Indemnification

You agree to defend, indemnify, and hold harmless VetKey and its officers, directors, employees, contractors, agents, affiliates, licensors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your content or conduct; (d) your violation of any law or third-party rights.

23) Dispute Resolution; Arbitration; Class Action Waiver (Recommended Default)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  1. Informal resolution first. Before filing a claim, you agree to contact us at support@myvetkey.com and attempt to resolve the dispute informally for at least 30 days.
  2. Binding arbitration. If not resolved, any dispute arising out of or related to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.
  3. Class action waiver. You and VetKey agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
  4. Venue. Arbitration will take place in Maricopa County, Arizona, unless the parties agree otherwise.
  5. Opt-out. You may opt out of arbitration and the class action waiver within 30 days of first accepting these Terms by emailing support@myvetkey.com with your name, account email, and a statement that you opt out.

If arbitration/class waiver is not enforceable in your jurisdiction, then Section 24 applies.

24) Governing Law and Venue (If Arbitration Doesn’t Apply)

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. If arbitration does not apply, you agree that disputes will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.

25) Changes to These Terms

We may update these Terms from time to time. We will update the “Last Updated” date when changes are made. If changes are material, we may provide additional notice through the Service or by email. Continued use after changes become effective means you accept the updated Terms.
